Terms

1. The offer
The campaign is free of charge in any case. Before the start, we agree in writing on the target, measurement method and period. If the target is reached, email management starts at €3,000 net/month for one month, after which it can be cancelled monthly. If it is missed, there are no costs and no obligation.
2. Who can participate
- The offer is aimed exclusively at entrepreneurs (Unternehmer) within the meaning of § 14 BGB (German Civil Code).
- An online shop is not required. The requirement is your own contacts (email addresses) that you may lawfully email, for example with newsletter consent or as existing customers within the meaning of § 7 (3) UWG (German Act against Unfair Competition).
- The contact person is the management or the head of marketing.
- Once per company. Agencies and resellers are excluded.
- There is no entitlement to participate. We review every enquiry within 24 hours (on working days) and tell you openly if it is not a fit.
3. Target agreement and measurement
Before the start, we agree in text form (Textform): the target (for example revenue in euros or number of enquiries), the measurement period and the measurement method. The standard is click attribution in Klaviyo with a window of 5 days after sending. Deviations only apply if they are recorded in the target agreement.
4. Process and approvals
We create the strategy, copy, design and technical implementation. You approve the campaign within 3 working days or state the changes you want. Nothing is sent without approval. If approval is delayed, the measurement period is postponed accordingly.
5. Email tool
If you do not have a suitable tool, we will set up Klaviyo in your name. You pay the costs of your email tool (e.g. Klaviyo) directly to the provider. The account, list and data remain with you in any case.
6. Outcome
Target reached: Ongoing email management starts at €3,000 net per month. The term is one month and renews by one month at a time. It can be cancelled at any time in text form (Textform) with effect from the end of the current contract month. You will receive the contract for review before the campaign starts.
Target missed: There are no costs and no obligation. You keep the campaign and the evaluation.
7. Rights to content
You receive a simple (non-exclusive), perpetual right to use the copy and design of the campaign for your company. We may use content provided by you (logos, images, product data) exclusively for the campaign; you warrant that you hold the rights to it.
8. Consent and data protection
You are responsible for ensuring that valid consent exists for all contacts who are emailed. Insofar as we process personal data on your behalf in this context, we will conclude a data processing agreement in advance (Art. 28 GDPR).
9. Prices
All prices are net, plus statutory VAT.
